Article 1: Definitions

The e-commerce service we provide via the internet.

1. Purchaser

A person who purchases products after fully understanding and agreeing to these terms and the privacy policy in accordance with the procedures specified by us.

A general term for individuals who search, view, or otherwise use the images, text, designs, logos, videos, programs, ideas, and other information (hereinafter referred to as “Content”) provided by us via this service, after fully understanding and agreeing to these terms and the privacy policy.

Article 2: Application of these terms

These terms are set forth to govern the use of this Service provided by us via the internet. Users are deemed to have accepted the content of these terms at the time they start using the Service.

Article 3: Changes to these terms

We reserve the right to change these terms within the scope of the purpose of this Service if we deem it necessary. If users or purchasers continue to use the Service after changes to the terms, they are deemed to have agreed to the revised terms.

Chapter 2: Product purchase

Article 4: Purchase of products

・ Users may purchase products from us through this service.

・ If a user wishes to purchase a product, they must apply to purchase it in accordance with procedures separately specified by us.

・ When the user clicks the order button after reviewing the delivery information, order details and other information entered and registered during the ordering process, and receives a confirmation email from us, a sales contract for the product is established between us and the user.

・ This service refers to the mail-order service provided by us via the internet.

・ Underage users must obtain prior consent from a legal guardian before purchasing products through this service.

Article 5: Changes to registered information

If a purchaser’s name, address, or other registered information changes after the purchase, they must promptly notify us. Even if the information is updated, transactions processed prior to the change will be conducted based on the information previously registered.

Article 6: Payment methods

・ The total payment amount for a product is the sum of the indicated product price, consumption tax, shipping fees and handling fees.

・ Payment for products purchased via this service is limited to the payment methods specified by us.

・ If paying by credit card, the purchaser must comply with the terms of the separate agreement they have with their credit card company. If any dispute arises between the purchaser and the credit card company regarding the use of the credit card, the parties involved must resolve it amongst themselves.

・ If the user is using a designated payment method for this service, and enters into a separate agreement (including but not limited to agreeing to the payment method’s terms of use) with the payment provider, the purchaser must comply with those terms. Any disputes arising between the purchaser and the payment provider must be responsibly resolved amongst involved parties.

Article 7: Product returns

We will address product return requests from purchasers in accordance with the “Special terms for returns” listed on the website under the “Notation based on the act on specified commercial transactions.”

6.Actions that interfere with the operation of this service or other services provided by us.

7.Actions that defame or damage our reputation or that we reasonably deem inappropriate.

8.Any other actions we deem inappropriate.

Chapter 5: Disclaimers

Article 10: Disclaimer

1.We shall not be held responsible for any damages caused to third parties due to users or purchasers violating these terms.

2.We do not guarantee the completeness, accuracy, certainty, usefulness, or any other aspect of the content or information obtained through this service.

3.In principle, we bear no responsibility for any damages arising from the use of this service by users or purchasers, and we are not obliged to compensate for such damages. However, if the contract based on these terms between us and the user or purchaser constitutes a consumer contract under Article 2, Paragraph 3 of the Consumer Contract Act (Act No. 61 of 2000), provisions that fully exempt us from liability shall not apply. In such cases, if we are liable for damages due to non-performance or tort and the contract is deemed a consumer contract, unless the damage was caused by our willful misconduct or gross negligence, the maximum liability shall be limited to the total amount paid by the user or purchaser to us under these terms during the one-year period preceding the occurrence of the damage.

4.If the purchaser fails or refuses to receive the product, cannot receive it due to prolonged absence or unknown delivery address, or is otherwise unable to receive the product due to their own circumstances, we shall fulfill our delivery obligation by contacting the purchaser at their registered contact details and delivering or sending the product to the designated delivery address; we shall in so doing be exempt from liability.

Chapter 6: Miscellaneous

Article 11: Copyrights and intellectual property rights

Content provided through this service shall exclusively belong to us or the rightful third-party holder. If any issues arise between a user or purchaser and a third party due to violation of this article, the user or purchaser shall resolve the issue at their own responsibility and expense and shall not cause any damage, loss, or disadvantage to us.

Article 12: Governing law

These terms shall be governed by the laws of Japan.

Article 13: Consultation and jurisdiction

If any matter is not stipulated in these terms or any doubt arises in the interpretation of these terms, we and the user or purchaser shall promptly resolve the issue through good faith consultation. All disputes related to these terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
